TERMS OF SALE





Article 1: Definitions



Catalogue: refers to the seller in which products are available.
Client: means the person who buys the products offered by the seller on the website and in catalogs.
Conditions: means the general terms and conditions of the website.
Parties: mean both the seller and the joint client.
Product (s): refers to goods sold by the seller and available on the website and in the seller, ie including hair products, cosmetics and beauty products.
Website: means the website available at www.rcut.fr. The website includes the infrastructure and content, including text, sounds and still or moving images.



Article 2: Scope – Enforceability



These general conditions define the rights and obligations of the parties in connection with the sale of products offered on the website or in catalogs.
Unless otherwise agreed in writing, the relationship between the parties is governed exclusively by these terms.
Any contravention opposed by the customer will, in the absence of express acceptance of salesman, unenforceable.
The customer declares to have read and accept the rights and obligations pertaining thereto. Any order placed with the vendor is subject to the terms and conditions.
These general conditions are subject to change in the conditions defined in
Article 12. The terms and conditions applicable to the order are those in effect on the website at the time of placing the order by the customer.



Article 3: Products


3.1 The products can be purchased by any person meeting the conditions set out in Article 4.1.
3.2-The Seller shall use its best efforts to ensure that the graphical representation of products on the website and catalogs to be as faithful as possible to the products themselves. However, given the format of digital products, it is possible that the perception by the customer of its photographic products may not exactly match the product itself
3.3-The product offers are valid until they are visible on the website and throughout the duration of the catalogs, subject to availability.
If out of stock of a product after placing the order, the customer will be notified by email within (maximum) 10 working days. With the exception of dates of annual closure of our suppliers (August 3 to 21) or the period is extended to 21 days. Therefore, if the product was the only available product described in the order, the vendor credits the client's portfolio to have an amount of the order and delivery charges which carries a refund by check to the customer's request.

Article 4: Order

The seller reserves the right to refuse a delivery or an order from a customer who has not fully paid or a previous order or with whom a payment dispute exists.
5.3-Secure
The seller has adopted the SSL secure payment system SOGENACTIF Bank Societe Generale, ensuring the confidentiality and security of banking transactions.
The seller never has access to personal and confidential information concerning the means of payment. That is why the customer's bank details will be required of each new order. Indeed, only the bank Societe Generale have confidential information (card number, expiration date) that are inaccessible by others.

 


Article 6: Delivery



6.1-Times
The seller agrees to deliver the ordered products within the maximum period for each product and noted in the announcement of sale appearing on the website or catalogs.
When ordering products available on different dates because of their availability, delivery time is based on the longest time.
In case of delay of more than seven (7) working days, the customer is given the opportunity to cancel the order by sending an e-mail customer service at the following address: salon@rcut.fr.
In this case, if they receive the product after its cancellation request, he will refuse stating
"refused to cancel delay".
If necessary, the seller will refund the product and the cost of return of the order no later than thirty (30) days from receipt thereof.
If the delay is caused by a force majeure as defined in the jurisprudence of French courts, the seller will inform the customer by e-mail that his request for cancellation may result.
6.2 - Delivery areas
The seller delivers the package anywhere in France (including Monaco and Corsica) and in the following countries: all countries of the European Union, Africa, Middle East, America and Asia.
Regarding the overseas departments, deliveries are only possible by post.
If demand for delivery outside coverage area, the sale would be automatically canceled and the customer would be fully reimbursed for the purchase and delivery costs associated with the latest within thirty (30) business days of order.
6.3 - Delivery address
Products will be sent to the delivery address specified by the customer during the ordering process. The customer should always choose the place of delivery and provide a phone number where he is contacted by post (or carrier) hours of delivery in case of problem.
The seller's liability shall in no way be if the package was delivered to the address listed in the order, regardless of the person to whom it was delivered.
6.4 - Reservations
Each delivery is deemed to be made available from the product or service to the client.
Without prejudice to the period in which the client under its right of withdrawal defined in

Article 7: Right of withdrawal



7.1-In accordance with article L121-20 of the Consumer Code, all products sold have a right of withdrawal for a period of seven (7) days from the date of receipt.
The return of all products will result in a refund equal to the total amount paid by the customer, ie the purchase price of the product (s) and shipping.
The return of only some of the products will result in a refund equal to the amount of product returned and the share of shipping the product.
Return costs and risks associated with returning product are the responsibility of the customer. Products must be returned in good condition, complete and adequately protected by means of a transport mode that provides guarantees similar to those proposed for the initial transport.

7.2-The refund will be made of the customer as soon as possible and no later than within thirty (30) working days of receipt by the seller of the request to exercise the right of withdrawal, provided that the product has been returned to the seller.



Article 8: Guarantees


8.1-Legal guarantee
The product warranties include the lack of conformity and hidden defects and no customer can apply for a guarantee greater than that registered.
In case of non-compliance of the delivered product, the customer may request the repair or replacement.

8.2-Disclaimer
Seller's guarantee does not cover the following cases:

·        misuse or improper handling

·        force majeure

·        using commercial or collective
 


Article 9: Intellectual Property


The website is the property of the seller.
All elements of the website (text, comments, works, illustrations and images, whether visual or auditory), are protected by copyright, trademark law, patent law, for the world wide. They are the exclusive property of the seller. Consequently, they may not be reproduced, operated or used for any purpose whatsoever.



Article 10: Privacy
